By purchasing a commission from Wynn Smith (the artist) you agree to be purchasing my services only. If you have a problem with any of the below conditions, they may be changed if discussed with me prior to paying for your commissioned piece.Read The Terms Carefully!I. COPYRIGHT AND USAGE
I, Wynn / iampaintbucket (the artist):
- Reserve the right to cancel and refund the order at any time for any reason.
- Retain all copyrights over the commissioned artwork.
- Will NOT claim the intellectual property (IP) of the commissioned artwork.
- Will NOT profit further from the commissioned artwork unless you (the customer) break any of the terms.
- Reserve the right to post the commissioned artwork online, in my portfolio as well as in publications such as art books.You (the customer/commissioner):
- May share the commissioned artwork across your personal websites and social media profiles.
- May NOT monetize the artwork, including reselling, redistributing, or using Print-on-Demand services, without my express permission.
- May NOT modify, edit, or alter the final artwork without my (the artist's) prior consent.
- Retain full ownership of the underlying intellectual property (IP).
- Are STRICTLY FORBIDDEN from inputting the artwork into generative AI tools or using it for AI training of any kind.
- May NOT utilize the commissioned piece for any commercial or business-related purposes.
- Must provide clear credit to @iampaintbucket wherever the artwork is displayed.The following is considered copyright infringement:
- Reproducing/using the copyrighted artwork commercially - means making money off it in any way not excluded from these terms.
- Claiming the artwork as your own.
- Altering the artwork without my consent.
- Using the artwork for AI training, scraping, or generative processing.Legal action will be pursued if necessary.II. CANCELLATION AND REFUND POLICY
WITHOUT a valid reason, the buyer will not be allowed a refund once I have started working on the commission.
IF, for any reason, I am unable to work on your commission or finish it, you will receive a full refund.
IF you cancel your order BEFORE I start working on the commission, you will receive a full refund.
IF you request a refund at any point when you were not allowed to ask for a refund you will lose all beforementioned rights to the commissioned piece and I will have the full right to profit further from it in any way. Furthermore, you may be blacklisted from commissioning me again.III. PAYMENT
Currency accepted are in USD or SGD (Converted from USD) or and can be paid through PayPal, PayNow, Revolut or Cash (in-person) ONLY for now.
Commissions can be payed 100% Upfront OR 50% Upfront and 50% after draft approval.
DO NOT send me the payment UNLESS I have agreed to give you the commission slot(s) and have requested for payment.IV. PROCESS, DELIVERY, REVISIONS
The time it takes to finish your commission varies from 1 week - 1 month depending on factors such as health, the complexity of the commissioned piece, other work, and personal reasons.
Once the piece is finished you will receive the image in both JPG and PNG file formats, one at a web-friendly size, and the other as a high-resolution image respectively.
IF the file size is still considered too big, don't hesitate to message or email me directly!
You will be provided images of the progress of the commissioned piece for revision (The amount of images depends on the complexity of the piece).
I will seek your approval for the draft(s) to ensure that the final piece will be to the client's expectations in order to avoid any dissatisfaction or change of minds.
A fee will be added if you want something changed on the final drawing - unless a misunderstanding from my side has been made.
IF you wish for me to change something in the draft you have previously approved, I will charge you a fee to change it. The amount of the extra charge depends on the change you want me to make and is usually based on an hourly wage.
IF your reference(s) is unclear to start with, changes will come at an extra charge.
IF the client is unsure of how to go on with the piece, and/or provide no references, the Artist will have the creative freedom to do as they wish with the piece while keeping the requests of the client.
